Welcome to Jobpreneur! These Terms of Service ("Terms") govern your use of the Jobpreneur platform (the "Platform"), operated by Jobpreneur ("we", "us", or "our"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Acceptance of Terms

By registering for an account or using the Platform, you agree to these Terms and our Privacy Policy. These Terms apply to all users, including clients seeking freelancers and freelancers offering services.

2. Eligibility

To use the Platform, you must:

Be at least 18 years old.

Have the legal capacity to enter into binding contracts.

Comply with these Terms and all applicable laws.

3. Account Registration

3.1 Account Creation:

You must create an account to use certain features of the Platform.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security:

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct

4.1 Prohibited Activities:

You agree not to engage in any of the following prohibited activities:

Violating any applicable law or regulation.

Infringing the rights of any third party, including intellectual property rights and privacy rights.

Posting false, misleading, or deceptive content.

Using the Platform for any fraudulent or illegal purposes.

Engaging in any activity that could interfere with, disrupt, or negatively affect the Platform or its users.

4.2 User Content:

You are solely responsible for the content you post, upload, or otherwise make available on the Platform ("User Content").

You grant Jobpreneur a non-exclusive, worldwide, royalty-free license to use, copy, modify, and distribute your User Content for the purpose of operating and providing the Platform.

5. Service Fees and Payments

5.1 Service Fees:

Jobpreneur may charge fees for certain services offered through the Platform. These fees are disclosed to you prior to your use of the services.

5.2 Payment Processing:

Payments between clients and freelancers are processed through our escrow system to ensure secure transactions.

Freelancers are paid upon successful completion of a project and client approval.

5.3 Disputes:

In the event of a dispute between clients and freelancers, Jobpreneur may, at its discretion, assist in resolving the dispute. However, Jobpreneur is not responsible for any disputes that may arise between users.

6. Intellectual Property

6.1 Jobpreneur’s Intellectual Property:

The Platform and its content, including text, graphics, logos, and software, are the property of Jobpreneur and are protected by copyright, trademark, and other intellectual property laws.

6.2 User Content:

Users retain ownership of their User Content. By posting User Content on the Platform, you grant Jobpreneur a non-exclusive license to use it as described in Section 4.2.

7. Termination

7.1 Termination by You:

You may terminate your account at any time by following the instructions on the Platform or contacting us directly.

7.2 Termination by Jobpreneur:

Jobpreneur may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activities, or if your continued use of the Platform could harm Jobpreneur or its users.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers:

The Platform is provided "as is" and "as available" without any warranties of any kind, either express or implied. Jobpreneur does not warrant that the Platform will be uninterrupted, error-free, or secure.

8.2 Limitation of Liability:

To the fullest extent permitted by law, Jobpreneur shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to indemnify and hold Jobpreneur, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your User Content, or your violation of these Terms.

10. Governing Law and Dispute Resolution

10.1 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the Benin Republic, without regard to its conflict of law principles.

10.2 Dispute Resolution:

Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If the parties cannot resolve the dispute amicably, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Benin Republic.

11. Changes to These Terms

Jobpreneur reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Platform and updating the effective date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
